The Eviction process in Illinois can vary from jurisdiction to jurisdiction. Chicago its own landlord tenant ordinance called the Residential Tenant Landlord Ordinance or RTLO. The rest of Cook County follows the Cook County RTLO which just went into effect June 2021 and was passed in January 2021. The ordinances are rife with pitfalls for both landlords and tenants that could result in lost rent, or lost right to occupancy.
Tenants should be aware that they have both rights and obligations with respect to their lease agreements that are both outlined by their lease agreement and supplemented by state and local law. While the ordinances above are the existing major statutory framework governing lease agreements in Cook County and Chicago other local municipalities may have their own rules and regulations, and of course areas outside of Chicago and Cook county will have their own ordinances to follow. The KRLG Team is also well equipped to helping you find a new place to rent with a landlord that will respect your rights.
Landlords should also be well aware of the ordinances governing their lease agreements. In Cook County Landlords should take the time to update their lease agreements and ensure that it does not violate the relatively new Cook County RTLO. The inclusion of prohibited clauses can cost a landlord up to two months rent and additional headaches as they attempt to resolve the issue with their tenant. Furthermore, self-help practices can cost the landlord additional rent and attorney fees for violation of their tenant rights. Violations can not only be costly but further the delay the possibility of successful eviction of a troublesome tenant.
